A lei Nº 14.874 foi sancionada no dia 13 de outubro de 2009, pelo governador em exercício, Jorginho Mello, após ser aprovada pela Assembléia Legislativa de Santa Catarina, no dia 29 de setembro.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;Com a nova lei, fica proibido o uso de cigarros e derivados do fumo em espaços de uso coletivo, público ou privado. A capital catarinense segue a decisão de outras capitais, como São Paulo, Rio de Janeiro e Porto Alegre, que proibiram o fumo em locais de uso coletivo.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;A multa inicial prevista para quem desrespeitar a legislação é de R$ 300 e dobra a cada reincidência. Na quinta ocorrência, o estabelecimento pode ter o alvará cassado. Segundo a prefeitura, a lei permite o uso de fumódromos, que devem ter entre 4,8 e 12 m², com área de 1,2 m² por pessoa. Fica proibida a venda e o consumo de alimentos e bebidas nestes locais.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;Com a lei Nº 14.874, fica obrigatória a afixação de avisos em locais de ampla visibilidade, indicando a proibição e as sanções aplicáveis, assim como a utilização do sinal internacional de proibição de fumar nos recintos onde for comum a presença de estrangeiros ou analfabetos.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;A prefeitura afirma que, entre os locais onde é proibido o fumo, estão casas noturnas, bares e restaurantes, tanto no interior quanto em varandas cobertas, além de garagens coletivas e terminais de ônibus, entre outros. A legislação libera os ambientes totalmente abertos, ou apenas com a proteção de guarda-sóis.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;Saiba os locais onde se pode e não pode fumar na capital do Estado de Santa Catarina e as conseqüências para quem descumprir a lei:&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;LUGARES PROIBIDOS:&lt;/span&gt;&lt;br /&gt;Fica proibido fumar cigarro, cigarrilha, charuto, cachimbo, narguilé e outros derivados de fumo. Bares e restaurantes devem ter áreas específicas para fumantes. Não será permitida a venda de cigarros ou bebidas alcoólicas em lan houses e cyber cafés com 5 ou mais computadores, instituições de ensino e saúde, aeroporto, centros comerciais, locais de lazer, praças desportivas, auditórios, interior de veículos de transporte público, comercial e profissional, como táxis, garagens de prédios e terminais de transporte rodoviário, hotéis e pousadas, cinemas, teatros, casas noturnas, refeitórios, praças de alimentação, entre outros estabelecimentos de acesso público que empreguem trabalhadores. Hotéis devem ter 30% dos quartos reservados para fumantes.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;O fumo só estará liberado em residências, vias públicas e ao ar livre.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;FUMÓDROMOS&lt;/span&gt;&lt;br /&gt;Fumódromos devem ser construídos seguindo termos presentes na lei, que devem ter entre 4,8 e 12 metros quadrados e não podem se comunicar diretamente com o ambiente interno do imóvel. Devem estar em área isolada e com exaustores para permitir a ventilação do ar. Não será permitido a venda de bebidas e alimentos nestes locais, ou o atendimento de garçons.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;QUEM FISCALIZA?&lt;/span&gt;&lt;br /&gt;A Vigilância Sanitária e a Guarda Municipal serão os fiscalizadores. Um número de telefone será disponibilizado para denúncias.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;MULTAS&lt;/span&gt;&lt;br /&gt;Consideram-se infratores os fumantes e os estabelecimentos por ela abrangidos. Como medida educativa, as multas serão aplicadas depois do infrator receber duas advertências por escrito. Para quem descumprir as normas da lei a multa será de R$ 300,00, dobrando a cada nova ocorrência. Na quinta chamada o alvará de funcionamento será suspenso por um mês, e na sexta, caçado.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;PERMISSÃO&lt;/span&gt;&lt;br /&gt;Fica permitido o fumo em charutarias/tabacarias desde que não ocorra a comercialização de alimentos e bebidas nestes locais.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: normal;"&gt;&lt;span style=";font-family:&amp;quot;;font-size:85%;"  &gt;&lt;span style="font-weight: bold;"&gt;POR QUE PARAR DE FUMAR?&lt;/span&gt;&lt;br /&gt;Só no Brasil, morrem cerca de 200 mil pessoas das 500 milhões de mortes anuais no planeta por causa do cigarro. Tourism Council, o Brasil é a 13º economia de turismo no mundo e a 1º na América Latina. Os dados foram coletados em 181 países avaliando a importância do turismo para o PIB, geração de empregos, divisas geradas por turistas internacionais e investimentos públicos e privados. O Brasil se destacou também na geração de empregos diretos e na rapidez de crescimento dos investimentos, se posicionando em 5º lugar nas duas categorias.
